These Terms of Service ("Terms") govern your access to and use of the website evlomd.com, our services, memberships, and communications provided by EVLO Wellness Ventures LLC ("EVLO," "EVLOmd," "we," "us," or "our"). By accessing our website, submitting a form, making a reservation, or using our services, you agree to be bound by these Terms. If you do not agree, please do not use our website or services.

1. Eligibility

Our services are available only to individuals who are 18 years of age or older. By using our website or services, you represent that you are at least 18 years old and have the legal capacity to enter into these Terms.

2. Services

EVLO provides health optimization, clinical aesthetics, and wellness services, including physician-supervised protocols. Certain services, including peptide therapy and prescription protocols, are available only following a consultation and evaluation by a licensed physician, who retains sole discretion over whether any protocol is appropriate for you. Nothing on our website constitutes a guarantee that you will qualify for any particular service or protocol.

3. Medical Disclaimer

• Content on our website is for informational purposes only and does not constitute medical advice, diagnosis, or treatment.
• Our services are not intended to diagnose, treat, cure, or prevent any disease except as determined by a licensed physician within a supervised protocol.
• Always consult a qualified healthcare provider before beginning any new health protocol. Never disregard professional medical advice because of something you read on our website.
• Individual results vary. Testimonials and examples are not a guarantee of specific outcomes.

4. Reservations & Memberships

• Submitting a reservation form expresses your interest in a membership and locks in the applicable founders' rate; it is not a binding purchase.
• Your payment method will not be charged until your selected location opens and your membership is activated.
• Membership rates, tiers, inclusions, and availability are as described at the time of your reservation and may change for future members.
• Founders' rates are locked for the life of a continuously active membership at the reserved tier.
• Memberships are personal and non-transferable unless we agree otherwise in writing.

5. 90-Day Performance Guarantee

Founding members who complete their first 90 days of membership and follow their prescribed protocol are eligible for a full refund of membership fees paid for that 90-day period if their member dashboard does not show measurable improvement in at least three tracked metrics, as described on our website. Eligibility requires completion of scheduled diagnostics and adherence to the prescribed protocol. Refund requests must be submitted within 14 days after the end of the 90-day period by contacting [email protected].

6. Payments, Cancellations & Refunds

• Prices for services and memberships are stated in U.S. dollars and may be updated from time to time for new purchases.
• Membership fees are billed on a recurring monthly basis once activated, until cancelled.
• You may cancel your membership at any time; cancellation takes effect at the end of the current billing period unless otherwise stated.
• Appointments cancelled with less than 24 hours' notice, or missed appointments, may be subject to a cancellation fee.
• Except as provided under the 90-Day Performance Guarantee or required by law, payments for services rendered are non-refundable.

7. SMS / Text Messaging Terms

By providing your phone number and opting in, you consent to receive text messages from EVLO Wellness Ventures LLC, which may include appointment confirmations, order updates, account notifications, and, where separately consented, promotional messages. Message frequency varies. Message and data rates may apply. Consent is not a condition of purchase. Reply STOP to opt out at any time, or HELP for assistance. 8. Acceptable Use

You agree not to:

• Use our website or services for any unlawful purpose
• Provide false, misleading, or fraudulent information, including health information
• Attempt to gain unauthorized access to our systems or interfere with the operation of our website
• Copy, scrape, or reproduce our content, branding, or materials without our written permission
• Resell, transfer, or share membership benefits without our written consent

9. Intellectual Property

All content on our website — including text, graphics, logos, images, videos, protocols, and the EVLO and EVLOmd names and marks — is the property of EVLO Wellness Ventures LLC or its licensors and is protected by intellectual property laws. You may not use our content or marks without prior written permission.

10. Disclaimer of Warranties

Our website and services are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the website will be uninterrupted, error-free, or secure.

11. Limitation of Liability

To the fullest extent permitted by law, EVLO Wellness Ventures LLC and its owners, officers, employees, physicians, contractors, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising out of or related to your use of our website or services. In no event will our total liability exceed the amounts you paid to us in the twelve (12) months preceding the event giving rise to the claim. Nothing in these Terms limits liability that cannot be limited under applicable law.

12. Indemnification

You agree to indemnify and hold harmless EVLO Wellness Ventures LLC and its owners, officers, employees, and affiliates from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your violation of these Terms or misuse of our website or services.

13. Governing Law & Disputes

These Terms are governed by the laws of the State of Wyoming, without regard to conflict of law principles. Any dispute arising out of or relating to these Terms or our services shall first be attempted to be resolved informally by contacting us. If unresolved, disputes shall be brought in the state or federal courts located in Wyoming, and you consent to the jurisdiction of those courts, except where applicable law requires otherwise.
